Erez Law is currently investigating former Foothill Securities, Inc. financial advisor Kevin Paul Hudak (CRD# 4439153) regarding use of non-authentic customer signatures for customer transactions. Hudak was registered with Foothill Securities, Inc. in Albuquerque, New Mexico from 2014 to 2015.
In November 2016, FINRA barred Hudak from acting as a broker or otherwise associating with firms that sell securities to the public. According to the FINRA Acceptance, Waiver & Consent, it is alleged that Hudak submitted non-solicitation forms to his member firm that had non-authentic customer signatures, which he allegedly obtained by having his customers sign blank forms and later photocopy and reuse for future transactions. These forms were required by Foothill Securities, Inc. in order to process low-priced securities transactions for his customers. It is also alleged that Hudak provided false and misleading testimony to FINRA regarding the forms.
Pursuant to FINRA Rules, member firms are responsible for supervising a broker’s activities during the time the broker is registered with the firm. Therefore, Foothill Securities, Inc. may be liable for investment or other losses suffered by Hudak’s customers.
