Miller has been the subject of two customer complaints between 2020 and 2021, according to his CRD report:
- April 2021. “Breach of fiduciary duty, negligence & negligent misrepresentation, breach of contract, failure to supervise.” The customer is seeking $464,050 in damages and the case is currently pending. The complaint was regarding direct investments and alternative investments, including business development companies (BDCs), real estate investment trusts (REITs), and direct participation programs (DPPs).
- July 2020. “Failure to conduct adequate due diligence, failure to recommend suitable investments and breach of fiduciary duty.” The customer sought $100,000 in damages and the case was settled for $36,882. The complaint was regarding real estate securities and direct investments.
Pursuant to FINRA Rules, member firms are responsible for supervising a broker’s activities during the time the broker is registered with the firm. Therefore, Kalos Capital, Inc. may be liable for investment or other losses suffered by Miller’s customers.
