Erez Law is currently investigating former Aegis Capital Corp. financial advisor Matthew DiGregorio (CRD# 2434158) regarding unsuitability and churning. DiGregorio was registered with Aegis Capital Corp. in Melville, New York from June to August 2015. Previously, he was registered with J.D. Nicholas & Associates, Inc. in Syosset, New York from 2013 to 2015 and Legend Securities, Inc. in Rockville Centre, New York from 2012 to 2013. DiGregorio was registered with 18 different brokerage firms in New York and Florida since 1994.
In November 2016, FINRA barred DiGregorio from acting as a broker or otherwise associating with firms that sell securities to the public after “DiGregorio was named a respondent in a FINRA complaint alleging that he failed to pay an award as ordered by a FINRA arbitration panel to his former partners at a FINRA member firm, and during the investigation that led to the disciplinary proceeding, he told FINRA staff that he does not intend to honor the award.” Additionally, the complaint alleges that DiGregorio refused to produce documents in response to the FINRA arbitration panel’s orders in relation to DiGregorio’s claims that his child was involved in an accident that resulted in the adjournment of the panel’s hearing sessions.
In August 2015, FINRA suspended DiGregorio after he failed to respond to a FINRA request to provide information regarding his status of compliance.
DiGregorio has been the subject of five customer complaints, two of which were denied and two closed without action, between 2006 and 2016, according to his CRD report:
- April 2016. “Unsuitability, breach of fiduciary duty, and churning.” The case was settled for $50,000.00.
- July 2009. “Client alleges an unsuitable amount of risk was exercised contrary to his objectives during the period of October 2008 through April 2009.” The case was settled for $24,400.
Pursuant to FINRA Rules, member firms are responsible for supervising a broker’s activities during the time the broker is registered with the firm. Therefore, Aegis Capital Corp. may be liable for investment or other losses suffered by DiGregorio’s customers.
