July 2024. “GWG Holdings, Inc. filed Chapter 11 bankruptcy on April 20, 2022. Complaint alleges unsuitable recommendations, misrepresentation and omissions of material fact, breach of contract, breach of fiduciary duty and, negligence and gross negligence related to an investment in GWG L-Bonds. On 08/12/2024, an amended Statement of Claim was filed by plaintiffs’ counsel, increasing the damage amount from $82,000 to $114,000. The amendment was not known to the firm until 11/05/2024, at which time a Form U4 amendment was filed to state the new amount.” The customer is seeking $114,000 in damages, and the case is currently pending. The complaint was regarding direct investments.
January 2022. “Unsuitable investments conspiring to circumvent firm policy.” The case was settled for $5,000. The complaint was regarding direct investments.
Pursuant to FINRA Rules, member firms are responsible for supervising a broker’s activities during the time the broker is registered with the firm. Therefore, Capital Investment Group, Inc. may be liable for investment or other losses suffered by Joseph Eades Jr.’s customers.
